These Terms of Service ("Terms") govern your use of Hands-Free Control ("the App," "the Software," "we," "us," or "our"), a desktop application that enables hands-free control of a computer using head movement and facial gestures via a webcam. The App is operated by Derar H. Mallah, an individual ("the Operator"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
01License
Subject to these Terms and payment of any applicable fees, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal or internal business use. You may not resell, sublicense, rent, or distribute the App.
02Plans, Free Trial & Payment
The App is offered under the following plans: a free trial, a monthly subscription, an annual subscription, and a one-time lifetime purchase. Current pricing is shown on our website, handsfreecontrol.com, and may change from time to time.
Payments are processed by our authorized reseller and merchant of record, Lemon Squeezy. When you make a purchase, Lemon Squeezy handles the transaction, billing, and applicable taxes, and your purchase is also subject to Lemon Squeezy's terms. Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time from the App's in-app settings or via your purchase receipt; cancellation stops future renewals and takes effect at the end of the current period.
The free trial provides access to App features for the stated trial period. We reserve the right to modify or discontinue the free trial at any time.
03Refunds
Refunds are handled in accordance with our Refund Policy and the policies of our merchant of record, Lemon Squeezy.
04Acceptable Use
You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by law; (b) use the App for any unlawful purpose; (c) interfere with or disrupt the integrity or performance of the App; or (d) attempt to gain unauthorized access to the App or its related systems.
05Camera & Privacy
The App requires access to your device's webcam to function. All webcam and facial-tracking processing takes place locally on your device. We do not upload, transmit, or store your camera video. For full details, see our Privacy Policy.
06Not a Medical Device
The App is an accessibility and productivity tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. It is not a substitute for professional medical advice, assistive-technology assessment, or supervised care. Use it at your own discretion.
07Intellectual Property
The App, including its software, design, branding, and content, is owned by the Operator and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
08Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or fully accurate across all hardware, lighting, or webcam configurations.
09Limitation of Liability
To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of or inability to use the App. Our total liability for any claim shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10Termination
You may stop using the App and cancel any subscription at any time. We may suspend or terminate your license if you breach these Terms. Upon termination, the rights granted to you under these Terms will end and you must stop using the App.
11Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by the "Effective date" above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
12Governing Law
These Terms are governed by the laws of the State of Qatar, without regard to its conflict-of-law provisions.
